How we handle personal data is explained in this privacy statement.This Privacy Statement is intended for all persons whose personal data we processes in the course of our services and is available here on www.imagin.studio or www.imaginstudio.com (the “Website”)

1. Who is responsible for the processing of your data?

In this privacy statement, we, IMAGIN.Studio B.V. (“IMAGIN.Studio” or “we”) explain how we process your personal data in our capacity as a controller. We also describe where we receive our data from and what that data comprises.

IMAGIN.studio processes your personal data for the services we provide. You provide us with your personal data when you conclude an agreement with us and/or when you use our services. As part of these services we may also receive personal data from third parties, such as software integrators or parties which have introduced you or your company to IMAGIN.studio with your permission, as required for the performance of our services.

  • Business addresses
  • Gender
  • Email address
  • Telephone number
  • Username and password or other identification information
  • User logs
  • IP-addresses
  • Company location
  • Payment details
  • Surfing behaviour, established on the basis of our own observations or cookies (see also article 8 of this privacy statement)

Please note: IMAGIN.studio does not process all personal data listed above in all cases. The personal data we process, depends on the nature and purposes of the services which you use. In addition, IMAGIN.studio may also collect personal data from public sources.

IMAGIN.studio does not intend to collect data from persons under the age of 16.

4. Processing: legal grounds and legitimate interests

The personal data is processed on the basis of the following legal grounds:

  • Consent
  • Performance of a contract with you
  • Legal obligation(s)
  • Performance of a task in the public interest
  • Legitimate interest(s) of IMAGIN.studio or a third party

Legitimate interests include, but are not limited to: digital security, IT management, research and analysis of our products and services, business administration, legal affairs and internal management.

5. Purposes of the processing of personal data

We exercise all due care in the processing of your personal data. We use only the data necessary to provide our services. IMAGIN.studio processes your personal data for one or more of the purposes set out below:

  • To process applications and inquiries from new customers (ground 1, 2 or 5)
  • To provide activities in the context of providing advice and information to companies that are potentially interested in becoming a direct or indirect partner or a customer of IMAGIN.studio (ground 1, 2 or 5)
  • To maintain and execute our agreements and deliver our services (ground 2)
  • For sending out invoices and requesting or making payments (ground 2)
  • In order to communicate with you and/or your company as a prospect, client or other business relation for information purposes and for the provision of services (including the service desk and to handle questions or complaints via social media, by mail, e-mail or telephone) (grounds 2 or 5)
  • To build up and maintain the customer relationship and provide information regarding (new) services (e.g. newsletters and/or marketing) (ground 2 or 5)
  • For our administration in order to meet legal, such as financial and tax-related, obligations (ground 2 or 3)
  • To develop and improve new and existing products and services (ground 5)
  • To fulfil statutory obligations, settling disputes and enforcing our rights and agreements (grounds 2, 3 or 5)
  • Analysing cookies of our websites in order to gear the contents of our communications to your personal preferences to the maximum possible extent (ground 1 or 5)

6. Sharing with third parties

Exclusively for the purpose of providing our services we provide business and personal data to our partners - including processors, software integrators and/or referring companies. Our partners include, in any case, the parties with whom IMAGIN.studio cooperates to provide the services to you or your company.

IMAGIN.studio only shares personal data with third parties after it has entered into an agreement with these third parties to ensure that your personal data is processed carefully and securely.

7. Retention of your data

We will retain personal data as long as necessary or permitted to do so within the framework of the purposes described in this privacy statement and in accordance with applicable law. The criteria used to determine the period of storage include:

  • The duration of the period in which we have an ongoing relationship with you and provide the services to you (for example, as long as you continue to make use of our services).
  • Whether there is a statutory obligation that we must meet (certain laws require, for example, that we retain our transaction records for a certain period of time before deleting them).
  • Whether retaining the data is desirable in consideration of our legal position (i.e. in regard to statutory prescription periods, disputes, investigations by regulatory institutions, etc.).

When you visit or use our website(s), services, applications, communications services (such as e-mail) and resources, we may use cookies, web beacons and other similar data storage technologies. 9. Leadinfo

We use the lead generation service provided by Leadinfo B.V., Rotterdam, The Netherlands, which recognizes visits of companies to our website based on IP addresses and shows us related publicly available information, such as company names or addresses. For additional information, please visit www.leadinfo.com. On this page: www.leadinfo.com/en/opt-out you have an opt-out option. In the event of an opt-out, your data will no longer be used by Leadinfo.

10. Your rights

You are entitled to know what personal data pertaining to you we process and to whom we have provided your personal data. If you have granted your consent to the processing of your personal data, you also have the right to revoke this consent.

If you wish to access, correct, update, restrict or delete the personal data pertaining to you that we process, wish to object to the processing of personal data or direct marketing, or if you would like to receive an electronic copy of your personal data for the purposes of providing it to another company (insofar as this right to transfer is granted to you under applicable law), contact us by sending an email. In your request, please be as specific as possible as to the personal data to which your request pertains. We will respond to your request as quickly as is reasonably possible, and in any event within the period required by law. Finally, you also have the right to lodge a complaint with the Dutch Data Protection Authority.

You can only exercise your rights to the extent that they are granted to you by law. To make sure that the request was submitted by you, we may ask you to include a copy of a valid form of identification with your request. We will only do this if we deem it necessary for the purposes of identifying you, and if we do this we will also ask you to obscure your passport photo, passport number and citizen service number (BSN). We will destroy the copy of your identification immediately after we have identified you.

11. Security and protection of data

IMAGIN.Studio takes appropriate security measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised alteration to the maximum possible extent. IMAGIN.Studio has implemented technical and organisational measures in order to secure your personal data, including the use of encryption.
